Seller: Polt Designs

Legal Entity: Poltavskiy Investments LLC

Polt Designs is a trade name and brand operated by Poltavskiy Investments LLC, an Idaho limited liability company ("Seller").

1. Overview

These Terms & Conditions (“Agreement”) govern the purchase and use of 3D scan data files provided by Polt Designs. By purchasing, downloading, or using any 3D scan data, the buyer (“Customer”) agrees to all terms outlined below.

2. Nature of Product

All products sold under this category are 3D scan-derived digital files, typically provided in .FBX format, representing real-world objects (e.g., vehicles or components).

These files are:
·         Generated using handheld and/or structured-light scanning methods
·         Processed and optimized for usability
·         Intended as reference geometry for design and fabrication workflows

3. Accuracy & Limitations

Customer acknowledges and agrees:
·         3D scan data is NOT equivalent to OEM CAD data
·         All scans may contain:
·         Minor surface noise
·         Soft edges or rounded features
·         Incomplete or occluded areas
·         Slight dimensional deviations

While Polt Designs aims for high accuracy, perfect precision is not guaranteed.
Important:

These scans are intended for:
·         Reverse engineering
·         Custom part development
·         General reference

They are NOT guaranteed to be suitable for:

·         Direct production without modification
·         Precision-critical engineering applications

4. Scale & Units

·         All scan files are exported to real-world scale to the best of our ability
·         However, Customer is solely responsible for:
·         Verifying scale upon import
·         Confirming dimensions before use in any application

5. Scanner & Capture Methods Disclosure

Polt Designs utilizes multiple scanning systems and workflows, including but not limited to:

·         Einstar1 (IR Mode)
·         Einstar2 (Laser Mode)

Due to varied project requirements:

·         Specific scanner, settings, or methodology will not be disclosed per individual scan
·         Scan quality may vary depending on:
·         Surface type
·         Accessibility
·         Environmental conditions
·         Required capture speed vs detail level

6. File Format & Compatibility

·         Files are provided in .FBX format only, unless otherwise stated
·         Customer is responsible for:
·         Ensuring compatibility with their software
·         Converting files if needed

Polt Designs is not responsible for software incompatibility issues.

7. Buyer Responsibility

By purchasing, Customer agrees:

·         They have reviewed all:
·         Product images
·         Descriptions
·         They understand the nature and limitations of 3D scan data
·         They will:
        ·         Ask questions prior to purchase if clarification is needed
        ·         Validate geometry before manufacturing or critical use

8. No Warranty

ALL FILES ARE PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND.
Polt Designs makes no guarantees, express or implied, including but not limited to:

·         Accuracy
·         Completeness
·         Fitness for a particular purpose
·         Merchantability
·         Performance in any specific workflow

9. No Returns / No Refunds

Due to the digital nature of the product:

·         ALL SALES ARE FINAL
·         No refunds, exchanges, or cancellations will be provided under any circumstances

10. Limitation of Liability

To the fullest extent permitted by law:
Polt Designs / Poltavskiy Investments LLC shall not be liable for any damages, including but not limited to:

·         Manufacturing errors
·         Financial losses
·         Project delays
·         Equipment damage
·         Indirect or consequential damages

Use of the files is entirely at the Customer’s own risk.

11. Intended Use

Scan data is intended for:

·         Design reference
·         Aftermarket/custom part development
·         Visualization

Customer agrees NOT to rely on scan data as certified engineering data.

12. Intellectual Property & Usage

·         All scan data remains property of Polt Designs
·         Purchase grants a non-transferable, non-exclusive license to use the files

Customer may:

·         Use scans for personal or commercial projects

Customer may NOT:

·         Resell, redistribute, or share raw scan files
·         Upload files to marketplaces or file-sharing platforms
·         Claim the scan data as their own work

13. No Fitment Guarantee

Polt Designs makes no guarantee that any scan data will result in parts that:

·         Fit correctly
·         Align perfectly with OEM components
·         Require no modification

All final fitment responsibility lies solely with the Customer.

14. Post-Processing Requirement

Customer acknowledges that:

·         3D scan data will require cleanup, modification, and/or remodeling before production use
·         Additional work such as:
·         Surface refinement
·         Retopology
·         CAD reconstruction
·         Dimensional correction

may be necessary.

Polt Designs is not responsible for any additional work required.

15. No Support Obligation

Polt Designs is not obligated to provide:

·         Technical support
·         File modifications
·         Custom adjustments
·         Software assistance

Any support provided is at sole discretion and may be refused.

16. Acknowledgment of Understanding

By purchasing, Customer explicitly acknowledges:

·         They understand the difference between scan data vs OEM CAD
·         They accept all limitations outlined above
·         They assume full responsibility for use of the files

17. Governing Law

This Agreement shall be governed by and interpreted under the laws of the State of Idaho, United States.
